I wish to adopt my son Daniel who has been in permanent care with me for the last five years with no contact from birth parents. He only knows himself by my surname and I am the only Dad he knows. Is adoption a possibility for me and how do I go about it. I have a biological daughter and an adopted son from Thailand who have my family name, and I don't want Daniel to feel any different.

Do you have a social worker? Do you or they have contact with the birth parents?
Different states have different rules, but i think the birth parents will have to be contacted to give them the opportunity to oppose or support the adoption.
You will have to go through the family court. Your social worker, or DHS should be able to give you info on whether this is a possibility.
If it is not a possibilty now, it will definately be a possibility once your son is over 18.

Welcome!
There is another father on this board who recently was successful in changing his son's surname to his own whilst being under a PC order - and he is in Victoria. So if this is your main concern, you might want to contact him in the meantime. I can't find his thread, but someone else probably will!

Michael, As far as I know adoption from a permanent care situation is not possible when the parents are not consenting. But as Sal said you can change the surname, our member weemankelsey has done it recently and you might want to drop him a pm how he went about it. But in any case you need to get in touch with your agency. Cheers

I don't have much advice, but thought I'd say hi. I have a 5 year old son from Cambodia, and I work in Melton. I am now in the application process for Permanent Care.

Hi all
I have sent a pm to Michael so hope he gets it ok, but just to confirm, yes if you have a child in permanent care with you, then you are the legal guardian (in Victoria at least!) and that means you make all decisions pertaining to your childs 'long term welfare'. These are parental responsibilities, and one of the areas you may deem to be important for your child's long term welfare is their surname, so you are able to register for a change of name at the Vic Registry of Births deaths and Marriages.
